As people are innovating and creating upgraded motor vehicles for road transportation, the number of motor vehicle accidents has also been increasing. In 2022, a report recorded that around 4 lakh motor vehicle accidents have happened, and every year around 1.5 lakh people suffer some form of disability due to an accident.

Unfortunately, one more such motor vehicle accident has happened wherein a diamond cutter lost his one eye. His disability was classified as a partial disability against which he filed a case in the Supreme Court of India.

Particulars Of The Case

Recently, a 30-year-old diamond cutter lost his complete vision in one eye due to a motorcycle accident on his way to Kunnamkulam. The accident happened because of an auto rickshaw driver who was driving abrasively on the road.

The diamond cutter’s disability was classified as a partial disability against which he filed a complaint on the grounds of his profession. The Motor Accident Claims Tribunal of Thrissur declared his disability as 49% only and provided him with compensation worth Rs. 8,70,000 with 8% interest. He further filed a complaint with the High Court, they declared his disability as 65% and provided him with compensation worth Rs. 10,57,500 lakh.

However, the man further filed his case with the Supreme Court of India. He has been fighting this since 2005 and waiting for justice.

Supreme Court’s Verdict

The Supreme Court of India ruled because, “The main process of cleaving and sawing clearly can be completed only when a person can see clearly, especially given the size of these precious stones. Seeing only with one eye, unquestionably makes it greatly difficult to carry out these processes effectively. 65 percent as functional disability, in our view, is yet again insufficient”.

The Supreme Court gave him Rs. 50,000 for all the pain and suffering he had to go through during this judicial process as ‘gross undervaluation’ and then raised it to Rs. 1,50,000.

Conclusion

After years of battle, the diamond cutter who lost an eye’s vision finally got the compensation and fair justice he was working for. The bench of the Supreme Court also expressed that “Pain and suffering are not only on account of physical pain but also suffering on account of what has been lost as a result of the accident – the desire of economic betterment, social betterment, etc. Once a person is unable to partake in his profession of choice, for no fault of his all these desires are unceremoniously ground to a halt”.

This judgment proves that the Indian Judicial System considers every aspect of a person’s life and is established to play fair to the people.
