SC/ST communities are sadly treated terribly in India, even in the ‘modern’ times. They face discrimination, violations, etc just for being from the Schedule Caste or Scheduled Tribe communities and it is still prevalent in India. The government has launched various government schemes and legal protection for the people from these communities to protect them from any harm or violation.

The Puducherry government decided to do something to protect the SC/ST communities. The "Prevention of Atrocities Act" scheme was introduced by the Adi Dravidar Welfare Department, Government of Puducherry. This state government scheme aims to provide immediate help to Scheduled Castes and Scheduled Tribes victims of atrocities. It offers financial relief, compensation for any losses they suffer, and support for their rehabilitation to help them recover and rebuild their lives.

What Is The SC/ST Prevention Of Atrocities Act?

The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 also referred to as the SC/ST Act was enacted to protect people belonging to the marginalised sections of society, especially those who come from SC and ST. The act criminalises a range of crimes committed against SC and ST individuals like physical assault, forced labour, and other forms of degrading treatment. The act mandates strict legal consequences for perpetrators so that justice is established.

The act was amended in 2016 and 2018 wherein provisions concerning misuse of anticipatory bail and timelines of trials and investigations were introduced. The law also provides rehabilitation services to victims like counselling, medical treatment, etc.

Need Of The Act

The need for the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 arises from the long-standing discrimination and exploitation faced by the people from the communities of SC and ST. The members of these communities have been targets of social and economic discrimination, physical violence, and denial of their fundamental rights. Hence a specialised act was introduced for them.

With the enactment of the act, the conditions of the SC/ST communities have improved but there are still significant challenges to overcome, especially in rural areas. There have been repeated reports of caste-based abuse, denial of services, biased treatment in public, etc. Women have been facing sexual harassment and exploitation. That’s why the SC/ST Act remains crucial in addressing these persistent inequalities and establishing fair treatment.

Punishment For Offence Atrocities

The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 prescribes a range of punishments based on the severity of the crime committed. Some of the key punishments are:

  • Basic offences: For general crimes like verbal abuse, physical assault, and social discrimination, the act imposes imprisonment for a minimum of 6 months up to 5 years with fines.

  • Severe offences: Crimes like wrongful dispossession from land, and bonded labour practices attract higher penalties like 5 years imprisonment to life imprisonment.

  • Sexual violence: Acts of sexual harassment, molestation, or assault attract more severe punishment with prison sentences ranging from a a minimum of 10 years to life imprisonment.

  • Repeat offenders: Individuals who are repeat offenders face increased penalties including life imprisonment based on the offence.

Eligibility Criteria

Victims have to ensure they meet the following eligibility criteria to apply for the SC ST Prevention of Atrocities Act.

  • Must be from Puducherry.

  • The applicant should be from a Scheduled Caste or Scheduled Tribe.

  • The applicant should have been affected by some form of atrocity.

Application Process

To apply for the SC and ST Prevention of Atrocities Act, victims can follow these steps after ensuring that they meet the eligibility criteria.

  1. Visit the Office or Sub-Office of the Adi Dravidar Welfare and Scheduled Tribes Welfare Department during office hours.

  2. Request the hard copy of the application form from the staff responsible for issuing and collecting filled-in applications.

  3. Fill in all the required fields in the application form.

  4. Attach copies of all the required documents.

  5. Submit the completed and signed application form along with the documents to the concerned authority.

  6. Ask for a receipt or acknowledgement from the authority where you applied.

  7. Ensure the receipt includes details like the date, time of submission, and a unique identification number if applicable.

Documents Required

The following documents have to be attached to the application form of the government scheme. Make sure all of the documents are ready and up to date.

If the applicant does not have an Aadhaar card, they can then submit any of these documents with their Aadhaar Enrolment ID.

  1. Bank or Post Office Passbook with Photo.

  2. Permanent Account Number (PAN) Card

  3. Passport

  4. Ration Card

  5. Voter Identity Card

  6. MGNREGA Card

  7. Kisan Photo Passbook.

  8. Driving license issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988).

  9. Certificate of identity having a photo of such person issued by a Gazetted Officer or a Tehsildar on an official letterhead.

  10. Any other document as specified by the Department.
